Liquor Licensing

An application for a liquor licence cannot be approved by the Department of Racing, Gaming and Liquor unless approval has first been granted by the local government through an Application – Section 39 and 40. Section 40 certificates are issued by Planning Services. A Section 40 must be granted before a Section 39.

Section 39 certificates demonstrate compliance with the Health Act (including Public Building Regulations), the Building Act, the Local Government (Miscellaneous Provisions) Act, and other written law relating to sewerage and drainage.

The certificates are required when there is:

  • A granting or removal of a licence;
  • An altering or redefinition of a venue;
  • An application for an alfresco area; and
  • An Application for 'liquor without a meal' permits

and at any other time that the Department of Racing, Gaming and Liquor determines that it is required.
