Application for Trading Permit - Mobile Food Vendor (Itinerant)

Terms and Conditions

 

    1. Compliance with Council's Activities in Thoroughfares and Public Places and Trading Local Law 2015; 
    2. Food businesses and operations must comply with the Food Act 2008, Food Regulations 2009 and the Food Safety Standards; 
    3. The permit holder and their assistants are responsible for compliance with the Environmental Protection (Noise) Regulations 1997; 
    4. Unless otherwise approved, solicitation of customers by touting or the use of public address systems is prohibited; 
    5. Trading is only permitted in accordance with the above stated trading permit holder name, assistants, hours and days of trade at the location indicated; 
    6. The permit holder must maintain the area in a clean and tidy condition at all times and is responsible for the disposal of litter and cleaning of footpaths; 
    7. The permit holder must not display or allow to be displayed any advertisement, placard, poster, streamer, sign or signboard other than attached to and forming part of the vendor’s food vehicle; 
    8. All vehicles and equipment must be maintained to a high standard; 
    9. A trader shall not park a vehicle or structure containing goods on any part of a thoroughfare so as to obstruct the movement of pedestrians or vehicles; 
    10. Food vehicles are not permitted to set up or provide external tables or chairs for customers; 
    11. Permit holders may be asked to vacate the location for other City approved events or works with prior notice being provided. Please refer to the City’s Calendar of Events: www.busselton.wa.gov.au/events; 
    12. Trading is not permitted within a distance of 300m of any permanent place of business that has for sale any goods or services of the kind being offered for sale by the mobile trader; 
    13. Itinerant traders are prohibited from trading within the Meelup Regional Park and Busselton and Dunsborough CBD. 
    14. The permit holder must maintain a minimum of $10 million Public Liability Insurance. The policy must be able to meet any possible claim which may be sustained against the permit holder or the City of Busselton in relation to the death or injury to any person or property arising out of any activity authorised by the permit.

    Schedule of Fees

    Application Fee $178

    Itinerant Trading Permit Fee: $1,790


    * Permit fees must be paid in full prior to the permit being issued.

    * ALL permit holders will be required to provide proof of a Public Liability insurance policy indemnifying the local government against all actions, damages, losses and expenses made against or incurred by the Local Government arising from an activity, action or thing performed or erected in accordance with the permit. The permit holder is to keep that insurance policy current for the duration of the permit. The public liability policy is to be for a minimum of $10 million.
