PUBLIC NOTICE

UNDER THE LOCAL GOVERNMENT ACT 1995

PROPOSED EASEMENTS

(Part Lot 308, 25 Prince Street Busselton)

In accordance with sections 3.58(3) and (4) of the Local Government Act 1995 public notice is hereby given that the City of Busselton intends to dispose of an interest in local government property as follows:

  1. Description of the affected property:

Part Lot 308 on Deposited Plan 135060 Volume 2981 Folio 358, 25 Prince Street, Busselton (Local Government Property)

  1. Details of Disposition:
  1. Nature of interest: Granting a drainage easement and overhang and support easement over part of the Local Government Property to benefit Lot 2 on Deposited Plan 418746, Volume 30 Kent Street Busselton (known as Busselton Central Shopping Centre). (Easements)
  2. Grantor: The City of Busselton as the registered proprietor of the property.
  3. Grantee: The Trust Company (Australia) Limited (ACN 000 000 993) and its successors in title as the registered Proprietor of Lot 2 on Deposited Plan 418746, Volume 30 Kent Street Busselton
  4. Consideration to be received by the City of Busselton: $160,000 (excluding GST).
  5. Market Value: The market value of the burden of the Easements on the value of the Local Government Property is $160,000 (excluding GST) as ascertained by a valuation carried out 1 July 2025.
  6. Term: The Easements are intended to run with Lot 2 on Deposited Plan 418746 until such time when the relevant infrastructure is permanently removed by the Grantee or is removed and not reinstated within 12 months of such removal.

Submissions are invited in relation to the proposed disposition, to be made in writing to the City of Busselton, Locked Bag 1, Busselton WA 6280 by close of business on Monday 22 December 2025.
